Supreme Court Stays Delhi HC order to register FIR against BJP leader Shahnawaz Hussain in rape case
On Monday, the Supreme Court halted all future actions against a BJP leader Shahnawaz Hussian in connection with a 2018 alleged rape case. The SC has also stayed the Delhi High Courts order to register an FIR against Hussian in the rape case.
The Bharatiya Janata Party (BJP) politician Syed Shahnawaz Hussain has been ordered to be the subject of a FIR after a lady reported being raped in April 2018 at a farmhouse in the Chhatarpur neighbourhood of south Delhi.
In addition, Justice Asha Menon questioned the Delhi police’s “total unwillingness” to even file a FIR and start the enquiry process. The judge ordered the police to complete the final their investigation and present a thorough report to the relevant trial court within three months in her ruling from August 17.
The trial court requested an action taken report after the victim filed her complaint case alleging rape by Mr. Hussain on June 21, 2018. (ATR). However, the Delhi police determined in its report that the investigation had not revealed any evidence to support the woman’s claims.
The high court’s instruction came as it rejected an appeal Mr. Hussain had made against the trial court’s judgement on July 7, 2018, ordering the filing of a FIR on the complainant’s complaint.
