SC refuses to pass interim order staying demolitions across states

The top court was hearing pleas filed by the Muslim body seeking directions to the Uttar Pradesh government and other states to ensure that no further demolitions of properties of alleged accused in recent cases of violence are carried out.

The Supreme Court stated on Wednesday that it cannot issue an omnibus order preventing authorities from acting and declined to issue an interim directive stopping demolitions in various jurisdictions.
Justices B R Gavai and P S Narasimha’s panel requested that the parties finish their legal arguments before hearing the Jamiat Ulama-i-petition Hind’s against demolitions on August 10. “There is no question that the rule of law must be upheld. How about an omnibus order though? Will we preclude the authorities from taking action against the violators if we pass such an omnibus order? the bench asked.

The top court was hearing appeals from the Muslim group asking it to provide directives to the governments of other states, including Uttar Pradesh, to stop demolishing the homes of people who have allegedly been involved in recent acts of violence.
