In rejecting a divorce request from a 51-year-old man, the Kerala High Court blasted the “consumer culture of use and throw” and made sweeping observations, one of which claimed that younger generations view marriage as “evil.”
Concerned about the “conscience of the society,” it emphasises the rise in live-in partnerships.
Rejecting the man’s request for divorce due to claimed “matrimonial cruelty,” a Division Bench of Justices A Muhammed Mustaque and Sophy Thomas issued the decision on August 24.
Since 2017, he has been having an extramarital affair, but the High Court judgement states that “there is nothing to prove that the chances of an amicable reunion are foreclosed permanently” because his wife, 38, is eager to accept him back. It should be noted that the pair has three daughters.

The phrase “Wise Investment For Ever” would be expanded to “Worry Invited For Ever,” replacing the previous idea “interprets the order.
The man was at the High Court after his petition was denied by a family court because his wife, who lives with their girls, refuted his allegations that she had physically abused him.
The husband has not been able to demonstrate any cruelty by the wife, the court ruled, in accordance with the Christian marriages’ application of the Divorce Act 1869.
The pair, who is originally from the Alappuzha area but has lived in Saudi Arabia for more than ten years, wed in 2009.
The husband filed for divorce in family court in 2018.
According to the High Court, Kerala, also referred to as “God’s own Country,” used to be well-known for its close-knit familial ties.
“But the current trend, it seems, is to dissolve the marriage for weak or self-serving reasons, or for extramarital affairs, even disregarding their children.
The cries and wails coming from disorganised and ruined families have the potential to shock society’s conscience.
“There is no doubt that it would badly effect the calm of our social life, and our society will have a stunted growth, when warring couples, abandoned children, and desperate divorcees occupy the bulk of our people,” it stated.
