A Bill presented in the Lok Sabha by Union Law Minister Kiren Rijiju amends the Family Courts Act and paves the way for the establishment of family courts in Himachal Pradesh beginning on February 15, 2019, and in Nagaland beginning on September 12, 2008. The first week of the monsoon session is anticipated to see the passage of this Bill. Reports state that the Business Advisory Committee has set aside four hours to discuss the bill.
With the goal of resolving the issue of the Family Courts’ lack of jurisdiction in the States of Himachal Pradesh and Nagaland, the Family Courts (Amendment) Bill, 2022 has been introduced.
The Government of Nagaland established two Family Courts in Dimapur and Kohima via notification on September 12, 2008, and Himachal Pradesh established three Family Courts at Shimla, Dharamshala, and Mandi via notification dated February 15, 2019, as well.
According to Section 1(3) of the Family Courts Act of 1984, the Central Government is yet to enact the same by publishing a notification in the Official Gazette.
By including a provison in Section 1(3) that allows for the creation of Family Courts in Himachal Pradesh and Nagaland, the Amendment Act intends to amend the Act of 1984.
